Summary

Authorizes the court to order a party to submit to a vocational training examination. Must be on motion, for good cause, with notice. The order specifies time, place, manner, conditions, and scope. A “vocational training counselor” must qualify as an expert under Evidence Code §720 and hold at least a master’s degree in behavioral sciences or equivalent postgraduate degree.

When to use

Cite when seeking a vocational evaluation to establish a party’s earning capacity for imputation under §4058(b). Supports arguments that a parent is voluntarily underemployed. Also cite defensively to require proper qualifications if the other side’s vocational expert is unqualified. Note: although located in the spousal support chapter, courts apply it in child support contexts as well.
