FC §4053

Type: California Family Code

Summary

Establishes the guiding principles for California’s statewide uniform child support guideline. Key principles: (1) a parent’s first obligation is to support minor children according to circumstances and station in life; (2) both parents are mutually responsible; (3) each parent pays according to ability; (4) children should share in the standard of living of both parents; (5) the guideline is presumptively correct; (6) orders should only fall below guideline under special circumstances.

When to use

Cite as the foundational authority for guideline child support. Useful when arguing that support should reflect actual income/lifestyle, that both parents must contribute, or that deviations below guideline require special justification.
