FC §3653

Type: California Family Code

Summary

Governs retroactivity of orders modifying or terminating support. A modification may be made retroactive to the date the motion was filed, or any later date. Special rules apply when modification is due to unemployment (retroactive to date of unemployment or service, whichever is later) or military activation.

When to use

Cite when seeking retroactive modification of child support — establishes that the court can backdate a modified order to the filing date. Also relevant for opposing retroactivity arguments.
