Summary

General rule on retroactivity: an order modifying or terminating a support order may be made retroactive to the date of filing of the notice of motion or order to show cause, or to any subsequent date, except as provided in subdivision (b) or by federal law.

When to use

Cite specifically when arguing for retroactive effect of a support modification back to the filing date. This is the default rule — the burden shifts to the opposing party to show why retroactivity should not apply.
